A Parkland man seen on video striking a security guard for taking too long to let him into his neighborhood has been sentenced to one year of probation, court records show.
Joaquin Pe Fagundo, 46, of Cascata, was arrested on Jan. 4 for burglary with assault or battery after a verbal altercation with a Marksman Security Corporation guard turned physical at the community entrance. The charges were later reduced to misdemeanor battery and trespassing, court records show.
On Aug. 6, Fagundo changed his plea from not guilty to nolo contendere, which allowed for his conviction without a technical admission of guilt, and received a sentence of one year’s probation, requiring monthly reports to a probation officer along with a host of other conditions, court records show.
Fagundo committed the assault when he and his wife were entering the Cascata community. After the security guard took possession of Fagundo’s ID card for verification, he and his wife became impatient with the amount of time he was taking and entered the guardhouse to obtain the ID card.
The security guard returned the ID card to Fagundo’s wife and asked them to leave the guardhouse. The video shows Fagundo becoming physical after reentering the guardhouse, striking the guard with an open palm on the back of his head.
The impact caused the guard’s head to hit the glass door, leaving a bruise on the right side of his forehead.
